As of November 1, 2014, statutory penalties will now apply to the abovementioned violations; texting and driving. There are increased penalties for persons holding a Commercial Driver's license. A conviction of a cell phone/texting violation for drivers with a probationary license, Class DJ, Class MJ or a learner permit will now result in a mandatory 120-day driver license or permit suspension. Under the law, newly licensed motorists convicted of texting while driving will have their license suspended for 120 days on the first offense, and revoked for a year if the offender is found guilty of a subsequent violation within six months of the license being returned. Conviction of a cell phone use or texting violation will also result in points being added to your DMV driving record. If you receive 11 points in an 18 month period, your driver license may be suspended.
